Terms & Conditions

Charter terms for Drive Mallorca: booking, payment, cancellation, security deposit, duties on board and liability.

Last updated: September 2026

1. Operator and scope

These terms apply to every charter agreement between Drive Mallorca, owner Dustin Cord, Naviera Balear c/o Drive-Mallorca, Avinguda de Gabriel Roca s/n, Ponent, 07013 Palma, Illes Balears, Spain (“we”) and the customer. Different terms of the customer apply only if we agree to them in writing.

2. How a booking becomes binding

A request sent through the website, WhatsApp, email or by phone is not yet a booking. The contract is concluded when we confirm the booking in writing (email or WhatsApp). After a request we hold the date, without obligation, for 24 hours.

3. Prices and services

The price confirmed at booking applies. All prices are in euros and include Spanish VAT (IVA) unless stated otherwise. What is included is listed on each yacht page.

  • Fuel is not included in the charter rate. On the Fairline Targa 52 “Cienfuegos” it is charged as a fixed surcharge per route, shown before you book; on the other boats it is charged at actual consumption.
  • Skipper: a licensed captain is always included on the Fairline Targa 52 and the Cranchi 41. On the Frauscher 858 a skipper is optional (€150 half day, €300 full day).
  • Extras such as tapas and drinks packages, Seabob or eFoil are charged in addition.

4. Payment

After our confirmation a deposit of 30 % of the charter rate is due, payable by payment link (credit card, Apple Pay) or bank transfer. The balance, fuel and extras are due at the latest when the charter starts. If the deposit is not paid in time we may withdraw from the contract and release the date.

5. Cancellation

  • Up to 24 hours before the agreed departure time: free cancellation, the deposit is refunded in full.
  • Later than 24 hours before departure, or no-show: the 30 % deposit is kept. Any amount paid beyond that is refunded.
  • Cancellation by us for weather or safety reasons: you choose between a new date and a full refund of the deposit. Further claims, for example for travel or hotel costs, are excluded.

Weather decision: Whether the boat sails is decided solely by the captain in charge, or by us as the operator, based on weather, sea state and safety. The captain may delay departure, change the route, shorten the trip or move the charter to another date. If no replacement date can be agreed, the deposit is refunded in full. This decision is not negotiable and applies even when it looks sunny in the marina.

6. Security deposit

For boats without a skipper a security deposit is held on the credit card: €1,500 for the Frauscher 858 and €500 per jet ski. It is released after the boat is returned without damage. Skippered charters carry no security deposit.

7. Duties of the customer

  • Arrive at the agreed time; a late start does not extend the charter.
  • Present valid photo ID and, when driving yourself, a licence valid for the size and power of the boat.
  • Follow the instructions of the captain or our staff; they are binding for everyone on board.
  • Alcohol and drugs: the captain and our staff may exclude individual guests or the whole group from the trip if they are significantly under the influence of alcohol or drugs, or behave in a way that endangers safety or the boat. This applies before departure and during the trip; in that case the captain may head for the nearest port and end the charter. No refund is given.
  • The maximum number of people on board must not be exceeded.
  • When driving yourself: treat the boat and equipment with care, follow the rules of navigation and protected-area regulations, and never anchor on Posidonia seagrass.

8. Liability

Damage caused by the customer: damage to the boat, its equipment or the water toys caused by the customer or their guests must be paid for by the customer. This also applies to skippered charters. The amount is based on repair or replacement cost plus loss of use for as long as the boat cannot be chartered. It is payable immediately; any security deposit is offset against it. Insurance payments are deducted; the excess is borne by the customer.

We are fully liable in cases of intent, gross negligence and for injury to life, body or health. In cases of slight negligence we are liable only for breach of essential contractual duties, limited to foreseeable damage typical for this type of contract. If the customer culpably damages the boat while driving it, the customer is liable within the limits of the security deposit and the insurance terms. We accept no liability for personal items brought on board.

9. Insurance

All boats are licensed for commercial charter and carry third-party liability insurance. Travel cancellation or accident insurance is not included; we recommend arranging your own cover.

10. Photos and video

We publish images of guests only with their explicit consent.

11. Data protection

How we handle personal data is explained in our privacy policy.

12. Governing law and place of jurisdiction

German law applies. The place of jurisdiction is Lemgo, Germany, unless expressly agreed otherwise and where the customer is a business or a legal entity under public law. For consumers, mandatory consumer protection rules and the statutory place of jurisdiction of their country of residence remain unaffected. Mandatory Spanish rules that apply to running the charter locally, such as safety and port regulations, also remain unaffected.

13. Final provisions

Should any provision be invalid, the rest of the contract remains in force. Changes and side agreements require text form.
